Terms and Conditions

This is a translation for convenience. The German version is authoritative; in case of any discrepancy, the German text prevails.

1. Scope

These Terms and Conditions govern your use of the online service Zusaga (the “Service”). The provider is the entity named above. Deviating terms of the user do not become part of the contract unless we expressly agree to them in text form.

2. Subject matter of the Service

Zusaga supports job hunting: searching, collecting and scoring job postings, tracking applications, and creating, checking and revising resumes and cover letters — in part using AI models.

Zusaga is a tool. We owe the provision of the features, not a particular outcome: we owe neither an interview nor a job offer, and we give no legal, tax or immigration advice. AI-generated text and scores can be incomplete or wrong. The user remains responsible for the accuracy of their application documents and must check every generated document before using it.

Job postings come from external sources. The company or portal that published a posting is responsible for its content and currency.

3. Formation of contract and account

The contract is formed when an account is created. The user must provide accurate information, keep their credentials secret and notify us of any misuse without delay. An account is personal and must not be passed on to third parties. The user must be of legal age.

4. Beta operation

The Service is in a beta phase. Features may change, be limited or be withdrawn; errors and outages can occur. We recommend keeping an additional copy of important documents outside the Service.

5. User obligations

The user undertakes not to use the Service unlawfully or abusively, and in particular not to

• infringe third-party rights, in particular by uploading or entering other people’s personal data without authorisation,
• post unlawful, insulting or misleading content,
• circumvent protective mechanisms, usage limits or quotas, scrape the Service automatically, or place excessive load on it,
• use the Service to make untrue statements in applications.

In the event of serious or repeated breaches we may suspend access temporarily or terminate the contract for cause.

6. User content

All content entered by the user and produced with the Service — in particular resumes and cover letters — remains attributed to the user; we acquire no rights in it. We process it solely in order to provide the Service; details are set out in the Privacy Policy.

7. Credits, prices and payment

AI features consume credits, which are recorded on the account. Credits are not legal tender, are not transferable and cannot be paid out.

Use is currently free of charge. During the beta we offer no paid services, no payment processing is set up, and no costs arise. Paid services will only be introduced after prices, scope and a withdrawal notice have been published here; they will apply only to orders placed afterwards and never retroactively.

8. Right of withdrawal

For paid distance contracts, consumers have a right of withdrawal under §§ 312g, 355 BGB. While the Service is free of charge (section 7), no paid transaction subject to withdrawal comes into existence. When paid services are introduced, a full withdrawal notice together with a model withdrawal form will be published at this point.

Independently of that, the user can delete their account at any time (section 10).

9. Availability

We endeavour to operate the Service with as little disruption as possible, but owe no particular level of availability. Maintenance, faults at upstream providers and events outside our control can lead to interruptions.

10. Term and termination

The contract runs for an indefinite period. The user may end it at any time without notice by deleting their account in the account settings; deletion is final and cannot be reversed. We may terminate the contract with 30 days’ notice in text form; the right to terminate for cause remains unaffected. Unused credits expire on termination unless they were acquired for payment and we are responsible for the termination.

11. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and to the extent of any guarantee given.

For slight negligence we are liable only for breach of a material contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the user may regularly rely), and then limited to the foreseeable damage typical of this type of contract. Liability is otherwise excluded.

These limitations also apply to the liability of our vicarious agents. For loss of data we are liable only to the extent that would have arisen had the user made proper and regular backups.

12. Changes to these Terms

We may amend these Terms where this is necessary to adapt to changes in the law, in case law or in the scope of the Service. We will notify changes in text form at least 30 days before they take effect. If the user does not object before they take effect, the changes are deemed accepted; we will point this out separately in the notification. If the user objects, either party may end the contract.

13. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. As against consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection of mandatory provisions of the law of their habitual residence. No special place of jurisdiction is agreed with consumers; the statutory rules apply.
